Welcome to Wervia ("we," "us," "our"). These Terms of Use ("Terms") govern your access to and use of the Wervia website, web application, and mobile applications (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Wervia is a vocabulary-learning application that provides lessons, exercises, and vocabulary tracking tools via web and mobile platforms.

2. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years old to create an account.

3. Subscriptions and Payment

• Wervia offers a free tier and a paid subscription tier ("Wervia Plus").
• Subscriptions are billed on a recurring basis (monthly or annually, as selected at checkout) until cancelled.
• Our order process is conducted by our online reseller, Paddle.com Market Limited ("Paddle"), which acts as Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle collects payment on our behalf using various payment methods and is responsible for tax collection and remittance where applicable.
• Prices are displayed in the currency shown at checkout and may vary by region.
• New subscribers may be offered a 3-day free trial. You will not be charged until the trial ends, unless you cancel before then.
• You can cancel your subscription at any time through your account settings or by contacting Paddle. Cancellation takes effect at the end of the current billing period.

4. Free Tier and Advertising

• The free tier of the Service includes a limited number of daily lessons.
• Additional daily lessons may be unlocked by viewing rewarded advertisements (mobile application only), served via Google AdMob.
• We do not control the specific content of third-party advertisements.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Circumvent usage limits, subscription paywalls, or advertising requirements through automated means
• Upload or share content that infringes the rights of others when creating custom word lists

6. User-Generated Content

You retain ownership of any custom word lists or content you create. By creating such content, you grant us a licence to store, process, and display it back to you as part of the Service.

7. Intellectual Property

All Service software, design, and content (excluding user-generated content) are owned by us or our licensors and protected by intellectual property laws.

8. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time via account settings.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee specific learning outcomes.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.
